最近有接到某位用户的留言,在后台问小白,我申请的美国商标,但是目前还没下R标,已经完成了品牌备案,最近发现有人跟卖,我投诉了几次后自己被判定为品牌滥用,该怎么办?
众所周知,亚马逊平台允许跟卖,并且在一定程度上鼓励跟卖。因为亚马逊跟卖的存在可以减少买家的购物时间,让买家获得更好的购物体验。
但是跟卖这个事情,对于卖家来说,就不是一件友好的事情了,虽然亚马逊也有赶跟卖的政策,但是基本都是针对已经拥有R标的卖家,对于TM标的卖家朋友来说,可谓是苦不堪言。
TM标如何赶跟卖
虽然TM标没办法进行透明计划,但是TM标备案成功后T一样是可以通过“违规举报”的方式,举报跟卖者ASIN侵权。
卖家朋友可以点击:品牌注册网站---违规举报选择站点---输入被跟卖的ASIN---选择投诉店铺---填写商标首次使用的日期---选择产品类目---填写订单号和问题内容即可完成投诉,一般都会在1-3个工作日得到回复。
但是在这里我们一定要注意!
TM标只是意向注册,并没有确实的商标权,滥用TM标赶跟卖,很容易触发品牌滥用。
一般来说,第一次使用TM标赶跟卖是不会被判定品牌滥用。如果在第一次投诉不成功的情况下,反复投诉同一ASIN,就很容易触发品牌滥用。
因此,大家在使用TM标投诉的时候,一定要小心谨慎。
